“The Campaign For The Five Million Children Begins Now!”

“Keep our Families Together!” “Give us our Day in Court!”

Today we begin a national campaign to protect mixed status families, faithful and loving parents and their beautiful U.S. citizen children. We are revising and renewing a class action suit on behalf of these U.S. citizen children who are living in the shadows with their undocumented parents, who are often deprived of their human rights to the love and protection of family and in some cases are subject to de facto deportation with their parents.

As we gather U.S. citizen children plaintiffs across the nation – including those who have been de facto deported, living now outside the country – we are also gathering attorneys and supporters in different Federal Court Districts to file versions of this class action. We are prepared to go to the Supreme Court in appeals or directly to the Supreme Court based on different legal strategies.

The original class action was set aside as we pursued legislative efforts on behalf of the children and their families. These legislative efforts came close, even passing legislation in the U.S. Senate. In the House of Representatives too we found support, including at one time even the current Speaker of the House.

Facing the reality of a Congress paralyzed by a small faction of the Republican Party in the House of Representatives we turned our effort towards an executive action by the President. Challenged in federal court, President Obama’s executive action was held hostage by a 4/4 tie vote in an incomplete Court. This executive action would have provided security for undocumented parents of U.S. citizen children.

We believe that as this campaign grows in support throughout the nation it provides hope for a legal solution utilizing the carefully vetted executive order program known as DAPA as a remedy.

We stand ready to enter mediation with the current Administration to achieve this same result in mediation. We are aware of the strong support in Congress - as well as the Republican Party dynamics that make a legislative solution unlikely for years to come. We are also aware of President Trump’s statement, at different times, that he would favor a humane solution to the current crisis faced by these families and their U.S. citizen children. It is our hope that the Administration will take advantage of this lawsuit to make these promises a reality.

We do not believe that the majority of people in this country are in agreement to separate these families and to deny these children their human rights as U.S. born and raised citizens. It is our intention to organize a “Children’s Brigade” from the over 5 million U.S. citizen children with undocumented parents that can bring alive the majority consensus on their behalf among people of all faiths and the people of these United States.
